Terms of Service

1. Agreement to Terms

By accessing or using Stack0 ("Service"), available at stack0.dev and app.stack0.dev, operated by Stack0 Inc. ("Stack0", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree, do not access or use the Service.

2. Description of Service

Stack0 provides developer infrastructure APIs accessible via API keys, SDKs, and the dashboard at app.stack0.dev. The Service includes:

  • AI Workflows: Multi-step AI pipeline orchestration, LLM chaining, document processing, and data enrichment
  • Integrations: Unified API access to 350+ third-party services including CRM, messaging, cloud storage, and productivity tools
  • Email: Transactional and marketing email delivery with tracking, templates, and deliverability monitoring
  • CDN & Storage: File upload, storage, image optimization, and global edge delivery via content delivery network
  • AI Extraction: Web page scraping, structured data extraction, and content-to-markdown conversion using AI models
  • Screenshots: Programmatic webpage capture, OG image generation, and visual rendering
  • Video: Video upload, transcoding, adaptive bitrate streaming (HLS), and delivery

We may add, modify, or discontinue features with reasonable notice. Core API endpoints will not be removed without at least 90 days notice and a documented migration path.

3. Account Registration and Security

You must create an account at app.stack0.dev to use the Service. When registering, you agree to provide accurate and complete information.

  • You are responsible for all activity under your account, including activity by team members in your organization
  • You must keep your account credentials and API keys confidential
  • API keys should be stored securely (environment variables, secrets managers) and never committed to version control or shared publicly
  • You must notify us immediately at hello@stack0.dev if you suspect unauthorized access to your account or API keys
  • We may require multi-factor authentication for certain account actions

4. Organizations and Team Access

The Service supports multi-user organizations. The organization owner is responsible for managing member access and permissions. Each organization has its own projects, API keys, billing, and data boundaries.

When you invite team members, you are granting them access to your organization's resources according to their assigned role. You are responsible for the actions of all members within your organization.

5. Acceptable Use

You agree not to use the Service to:

  • Send spam, phishing, or unsolicited bulk communications via the Email API
  • Send emails to purchased, rented, or scraped email lists
  • Distribute malware, viruses, or harmful content via CDN or any other API
  • Store, host, or distribute illegal content including child sexual abuse material
  • Violate any applicable laws, regulations, or third-party rights
  • Infringe on intellectual property rights of others
  • Scrape or extract data from websites in violation of their terms of service using the Extraction API
  • Use AI Workflows or Extraction to generate deepfakes, disinformation, or impersonation content
  • Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure
  • Circumvent rate limits, abuse sandbox environments, or exploit free tier allocations
  • Interfere with or disrupt the Service or its infrastructure
  • Resell, redistribute, or white-label the Service without a written agreement
  • Use the Service to build a competing product that replicates core Stack0 functionality

We may investigate suspected violations and may suspend or terminate accounts that violate these terms without prior notice for severe violations.

6. Product-Specific Terms

6.1 Email

You must comply with all applicable email laws including CAN-SPAM (US), CASL (Canada), and GDPR (EU). You must only send email to recipients who have consented to receive it. Marketing emails must include a functioning unsubscribe mechanism. We reserve the right to suspend email sending if bounce rates exceed 5% or spam complaint rates exceed 0.1%.

6.2 CDN & Storage

Files uploaded to the CDN are stored in AWS S3 and served via our edge network. You are responsible for ensuring you have the rights to upload and distribute all content. We may remove content that violates these Terms or applicable law. Storage limits and bandwidth are determined by your plan.

6.3 AI Extraction

The Extraction API fetches and processes publicly accessible web pages. You are responsible for ensuring your use complies with the target website's terms of service and robots.txt directives. We do not guarantee the accuracy or completeness of extracted data. Extraction results are not cached or retained beyond the API response unless you explicitly store them.

6.4 Screenshots

The Screenshots API renders web pages in a headless browser. Generated screenshots are returned in the API response and not stored by us unless uploaded to your CDN storage. You are responsible for any content captured and how you use or distribute the resulting images.

6.5 AI Workflows

AI Workflows may invoke third-party AI models (OpenAI, Anthropic, etc.) on your behalf. You are bound by the applicable model provider's usage policies. We pass your data to these providers only as necessary to execute your workflow. Workflow execution logs are retained based on your plan's retention period.

6.6 Integrations

The Integrations API connects to third-party services using OAuth tokens or API credentials you provide. You are responsible for complying with each third-party service's terms. We store your integration credentials encrypted at rest and use them only to execute API calls on your behalf. Revoking access in the third-party service may cause integration calls to fail.

6.7 Video

Videos uploaded for transcoding and streaming are processed and stored in our infrastructure. You retain all rights to your video content. We create derivative formats (multiple bitrates, HLS segments) solely to provide the streaming service. You are responsible for ensuring you have the rights to distribute all video content.

7. Pricing and Payment

The Service uses usage-based pricing. Current pricing is published at stack0.dev/pricing. You select a plan with a monthly minimum spend that converts to usage credits at published rates. Usage exceeding included credits is billed at per-unit overage rates.

  • All prices are in US dollars (USD)
  • Payment is processed monthly via Stripe
  • You authorize us to charge your payment method on file for all fees incurred
  • Failed payments will be retried up to 3 times over 7 days
  • Accounts with unpaid balances may be suspended after 14 days and terminated after 30 days
  • All fees are non-refundable except as required by applicable law
  • We may change pricing with 30 days written notice via email
  • Sandbox and development environments have separate usage limits and may be rate-limited more aggressively

8. Free Tier and Trials

We may offer free tiers or trial periods at our discretion. Free tier usage is subject to these Terms and may have additional restrictions on volume, features, or support. We reserve the right to modify or discontinue free offerings with 14 days notice. Abuse of free tier allocations (including creating multiple accounts) may result in termination.

9. API Usage, Rate Limits, and SLAs

Your plan determines your API rate limits (requests per second) and monthly quotas. Rate limits are enforced per API key. Exceeding rate limits will result in HTTP 429 responses.

We target 99.9% uptime for production APIs measured monthly, excluding scheduled maintenance windows announced at least 48 hours in advance. This is a goal, not a contractual SLA. Enterprise customers may negotiate a formal SLA with financial remedies under a separate agreement.

We reserve the right to throttle or suspend access if usage patterns are abusive, cause degraded performance for other customers, or are inconsistent with normal API consumption patterns.

10. Data and Content Ownership

You retain all ownership rights to data and content you upload, send, or process through the Service ("Your Content"). You grant us a limited, non-exclusive license to store, process, cache, and transmit Your Content solely as necessary to provide and improve the Service.

You represent and warrant that you have all necessary rights to Your Content and that Your Content does not violate any third-party rights or applicable laws. You are solely responsible for the content of emails you send, files you upload, data you extract, and integrations you configure.

11. Intellectual Property

The Service, including its APIs, SDKs (published on npm and PyPI), documentation, dashboard, branding, and underlying technology, is owned by Stack0 Inc. and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms and your plan.

Our SDKs are licensed under the MIT License. The MIT License applies only to the SDK source code, not to the Service itself. You may not use our trademarks, logos, or branding without prior written consent.

12. Confidentiality

Each party agrees to keep confidential any non-public information disclosed by the other party, including API keys, account data, pricing terms, and technical information. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

13. Indemnification

You agree to indemnify and hold harmless Stack0 Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

14. Limitation of Liability

To the maximum extent permitted by law, Stack0 Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, regardless of the cause of action or theory of liability.

Our total aggregate liability for all claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) $100 USD.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability.

We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) results obtained through the Service will be accurate or reliable; (c) third-party integrations will remain available or compatible; or (d) AI-generated outputs from Workflows or Extraction will be free of errors or hallucinations.

16. Suspension and Termination

By you: You may cancel your account at any time from your dashboard at app.stack0.dev. Cancellation takes effect at the end of your current billing period. You remain responsible for any usage charges incurred before cancellation.

By us: We may suspend your account immediately for: (a) violation of the Acceptable Use policy; (b) suspected security breach; (c) activity that threatens the stability of the Service. We may terminate your account with 14 days notice for: (a) non-payment; (b) material breach of these Terms; (c) inactivity exceeding 12 months on a free plan.

Effect of termination: Upon termination, your API keys are revoked immediately. Your Content (files, logs, data) will be deleted within 30 days. You may request a data export before termination. We may retain aggregated, anonymized usage data indefinitely.

17. Dispute Resolution

Any dispute arising out of these Terms shall first be addressed through good-faith negotiation between the parties for a period of 30 days. If unresolved, disputes shall be settled by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in English in Delaware, USA. Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action, class arbitration, or representative proceeding.

18. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any judicial proceedings not subject to arbitration shall be brought in the federal or state courts located in Delaware.

19. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email to the address associated with your account or through a banner in the dashboard. The updated Terms will indicate the new "Last updated" date. Continued use of the Service after the effective date constitutes acceptance. If you do not agree with the updated Terms, you must stop using the Service before they take effect.

20. General Provisions

  • Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Stack0 Inc. regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No waiver: Failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
  • Force majeure: Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, pandemic, or internet infrastructure failures.
  • Notices: Notices to Stack0 must be sent to hello@stack0.dev. Notices to you will be sent to the email address on your account.
